FLOOR AMENDMENT EXPLANATION

 

1.    Specifies that in a consolidation election, a majority of the total votes cast must approve a consolidation between a common school district that is part of a union high school district made up of two or fewer common school districts, with a union high school district.

2.    Specifies, that for all other school district consolidations, if a majority of the votes cast in each district approve the consolidation, the districts are consolidated into one district starting July 1 following the election.

3.    Reinserts existing language for canvassing the votes for consolidation of parts of two or more school districts and applies this to all consolidations, except for the outlined consolidation between a common school district and a union high school district.

4.    Specifies, if the outlined consolidation between a common school district and a union high school district formed a unified school district, the resulting district must continue to admit high school pupils residing in a common school district, that is not part of a unified school district consolidation and pay tuition for the high school pupils.

5.    Makes technical and conforming changes.

"2.  For elections to consolidate under subsection B, paragraphs 1 through 6 of this section, if a majority of the votes cast in each district approved the consolidation, the districts are consolidated and become one district from and after June 30 next following the election.  If parts of two or more school districts are proposed to be consolidated, a majority of the voters in the part of a school district or districts not affected by the proposed consolidation and a majority of the voters in the part of the school district or districts proposed for consolidation must approve the consolidation."

"S.  If a common school district that is part of a union high school district made up of two or fewer common school districts consolidates with that union high school district to form a unified school district as prescribed by law, any common school district that is not included in the consolidation shall become a common school district that is not within a high school district and is subject to section 15951.  The unified school district shall admit high school pupils who reside in a common school district that was located within the boundaries of the former union high school district.  The common school district shall pay tuition for high school pupils as specified in section 15824 and subject to section 15448, subsection J."
